Court dismisses e.tv’s encryption complaint

The North Gauteng High Court in Pretoria has ruled against the legal case presented by e.tv for the implementation of encryption in set-top boxes for digital terrestrial television (DTT).

The court affirmed that the amendments to the broadcasting digital migration policy that were gazetted on the 18th of March 2015 were in the best interest of the public. Minister of communications, Faith Muthambi, said in a statement that “the ruling... will now allow the digital migration process to progress and be concluded as soon as possible so that the benefits can be realised.”

While the decision represents a victory to both the Department of Communications and MultiChoice, it remains a possibility that e.tv will seek leave to appeal the judgement.
